1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern the supply and installation of uPVC and Aluminium windows and doors (“Products”) by House Makers (“Company”) to you. By placing an order with the Company, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Orders and Quotations

  • All orders must be placed in writing and confirmed by a written quotation from the Company.
  • Quotations are valid for 3 days from the date of issue and are subject to change without prior notice.
  • The quotation will detail the Products, specifications, quantities, prices, estimated delivery and installation timeframe, and payment terms.

3. Pricing and Payment

  • Prices listed in the quotation are exclusive of taxes, which will be added at the prevailing rate.
  • A 50% deposit is required upon order confirmation. The remaining balance is due before or upon delivery and installation, as agreed in the quotation.
  • Payment methods accepted are Bank Transfer, UPI, Cash, Cheque, etc

4. Delivery and Installation

  • The Company will arrange delivery and installation of the Products on a mutually agreed-upon date.
  • Customer is responsible for ensuring clear and unobstructed access to the installation area.
  • Any delays in installation due to Customer-related reasons may incur additional charges.
  • The Company will take reasonable care during delivery and installation to minimize disruption to the property. However, the Customer acknowledges that some dust and debris may be generated, and the Company is not liable for minor cleaning associated with the installation process.

5. Warranties

  • We offer a warranty on the materials and workmanship of our windows/doors. Warranty details will be provided during the quotation process.
  • This warranty covers the functionality of the uPVC/Aluminium profiles and hardware used in manufacturing the windows/doors.
  • Glass breakage, damage caused by fair wear and tear, misuse, neglect, improper installation, alterations, or acts of God are not covered under warranty.
  • The Company’s sole obligation under warranty is to repair or replace, at its discretion, any defective Product.

6. Limitation of Liability

  • The Company’s liability under these terms is limited to the cost of the Products and their installation.
  • The Company shall not be liable for any indirect, consequential, or incidental damages arising from the supply or installation of the Products.

7. Cancellation

  • Orders can be cancelled before production commences with a full refund of the deposit.
  • Once production has begun, a cancellation fee of 50% of the total order value will be applicable.

8. Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including acts of God, war, terrorism, strikes, or material shortages, etc.

9. Dispute Resolution

Any dispute arising from these Terms shall be settled through DELHI JURISDICTION.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of INDIA.

11. Entire Agreement

These Terms constitute the entire agreement between the Company and the Customer regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

13. Notices

All notices required or permitted under these Terms shall be in writing and shall be deemed to have been duly given when delivered in person, sent by registered post, or sent by email to the addresses set forth below:

14. Waiver

No waiver by the Company of any breach of any provision of these Terms shall be construed as a waiver of any other or subsequent breach.
